Even though the vast majority of people will not pay estate taxes, the high cost of probate in California makes it a necessity to have a living trust or other structure to avoid probate. Probate applies if someone dies with $150,000 (without reducing for mortgages or other debts) or more in assets whether or not they have a will. So anyone who owns a home needs a trust.
